BIOGRAPHY

Joseph Potocki (Joe) has represented national developers, property owners, specialty contractors, design professionals and product manufacturers for over 30 years. He is one of San Diego’s foremost real estate and construction law attorneys, with extensive experience litigating high-value disputes related to real estate, business, construction defects, personal injury, mechanic’s liens, Miller Act and delay, acceleration and inefficiency claims. Additionally, he has worked on hundreds of transactional matters on behalf of his clients including business formation and contract drafting, review and negotiation.

His long history of successful client representation in complex claims includes a $100-million claim pursued by a general contractor client on construction of world class 5-Star resorts, recovery of millions of dollars for property damage due to a slope retaining wall failure against an international retailer, and representing a national builder in a matter involving an explosion in an international hotel while under construction. Other representative matters include recovering delay damages and attorney fees in a partnership dispute between construction companies on cutting-edge construction methods/intellectual property rights and representing a renowned general contractor through OHSA involvement and litigation in a matter involving alleged injuries sustained on a large construction site.

Experience, a common-sense approach, and a reputation for obtaining results are hallmarks of Joe’s practice. In particular, Joe is known for his outcome-driven strategies, his ability to deliver results efficiently and cost-effectively, and his personal, high-touch relationships with clients.

Joe is an active participant in San Diego’s legal community and the building and construction industries.  He is a member of the Building Industry Association, Associated General Contractors of America – San Diego Chapter, and the San Diego County Bar Association. He previously served on the Board of Directors of San Diego Defense Lawyers and he was formerly an arbitrator for both the Better Business Bureau and the City of Del Mar.

Every year since 2013, Joe has been named to the Super Lawyers list of Top Attorneys in Construction Law in San Diego and he was also named one of the top 25 attorneys in construction and real estate by the San Diego Daily Transcript. Joe is a member of the prestigious Construction Law Society of America. He earned his law degree from California Western School of Law and a Bachelor of Arts degree from the University of California at Irvine.
